While San Francisco 49ers quarterback Colin Kaepernick was busy enjoying himself at a Los Angeles beach, fans up in northern California were fretting over the star’s choice of headwear.

Instead of sporting a Niners cap, the former Nevada Wolf Pack star had a Dolphins hat on. The “incriminating” photo of Kaepernick’s beach day can be seen below.

Now, Kaepernick could have simply done nothing. He does not have to have an Instagram account, let along post to it. He could have simply gone about his business, hitting the weight room on the fifth of July.

Instead, he posted the above photo along with the caption:

“This the hat y’all mad at? I’m goin wear what I want regardless of what you think,” Kaepernick wrote, “all you need to worry about is the fact that I grind for my teammates and the 49ers! I plan on doin this until they won’t let me in the building!”

This is the middle of the summer and well into football’s offseason, so yes, there are legions of fans who may be a little bored. That being said, and considering the fact that there are fans out there are are snapping up Aaron Hernandez jerseys as quickly as they can (seriously, check out Amazon’s current list of top-selling football items), what hat Kaepernick chooses to wear is pretty far down the list in terms of NFL fashion worries these days.

It is also pretty far down the list of what the 49ers are worried about. Remember how they are going to be trying to win a Super Bowl next year? Yeah, that’s probably just a touch bigger deal than Kaepernick’s headgear.

But it is interesting that the quarterback basically admitted to not caring about what fans think.
